1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your use of myPilotPost and any related services provided by Thuthu (Pty) Ltd ("we," "us," "our," or "myPilotPost"), a company registered in South Africa with registration number 2025/102758/07.
By accessing or using myPilotPost, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

4. Eligibility and User Requirements

- Subscription fees are billed in advance on a recurring basis
- You authorize us to charge your payment method for all fees
- You must provide current, complete, and accurate payment information
- Failed payments may result in suspension or termination of Services

We reserve the right to change our fees at any time. We will provide you with reasonable notice of any fee changes. Your continued use of the Services after the effective date of fee changes constitutes your acceptance of the new fees.
9. Cancellation and Refunds

- You may cancel your subscription at any time
- Cancellations take effect at the end of the current billing period
- Refunds are subject to the terms specified in our Refund Policy

We do not guarantee that:
- The Services will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Services will be accurate or reliable

- Any errors in the Services will be corrected
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THUTHU (PTY) LTD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, use, goodwill, or other intangible losses
- Any damages resulting from your use or inability to use the Services
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Services
- Any bugs, viruses, or other harmful code that may be transmitted through the Services by any third party
Our total liability to you for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
- Any Content you submit, post, or transmit through the Services

17.2 Jurisdiction
You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be instituted in the courts located in Johannesburg, South Africa, and you irrevocably submit to the exclusive jurisdiction of such courts.
17.3 Consumer Protection
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Protection Act, 2008 (South Africa) or any other applicable consumer protection legislation.
18. Dispute Resolution
18.1 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first contact us at legal@mypilotpost.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve any disputes within 30 days.
18.2 Arbitration (Optional)
If informal resolution is unsuccessful, either party may refer the dispute to arbitration in accordance with the Arbitration Act, 1965 (South Africa), with arbitration to take place in Johannesburg.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
20. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of myPilotPost.
21. Assignment
You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign, transfer, or delegate these Terms or our rights and obligations hereunder to any third party without restriction.
22. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and myPilotPost concerning the Services and supersede all prior or contemporaneous understandings and agreements, whether written or oral.
23. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, pandemics, labor disputes, governmental actions, or failures of third-party services.
24. Survival
All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.
